humanitário, o genocídio de Srebrenica apresentou desafios legais e logísticos únicos
excepcionais, devido ao grande número de vítimas, testemunhas, perícias médico-
legais, incidentes e documentos probatórios envolvidos

O TPIJ e o TPIR foram criados como órgãos das Nações Unidas, que até então nunca
tinha administrado justiça penal internacional. Por conseguinte, a necessidade de
estabelecer um equilíbrio entre as prioridades das operações de investigação criminal e
a detenção de suspeitos e observância de outros princípios das Nações Unidas criou
desafios legais, institucionais e operacionais específicos para o Procurador no
cumprimento do seu mandato para investigar os crimes e iniciar o procedimento
criminal no Tribunal. Tais desafios foram aumentados com a complexidade dos crimes,
sua magnitude pura, os desafios colocados pelo ambiente físico na ex-Jugoslávia, as
preocupações de segurança das potenciais testemunhas e o facto de que nos primeiros
anos as detenções dos suspeitos frequentemente precederam as investigações.

5. Algumas questões
Os crimes de genocídio, contra a humanidade e de guerra (em geral, crimes de guerra)
são, por definição, de caráter massivo. Os crimes internacionais têm carácter
sistemático ou generalizado. Assim, pode inferir-se que as ações dos autores foram
coordenadas e organizadas por militares e/ou funcionários civis de alto escalão. Por
outro lado, o seu caráter massivo implica uma abordagem diferente da do nível
nacional em "selecionar", investigar, indiciar, provar, julgar, definir responsabilidades,
punir, reparar e executar sanções.
Em suma, isto significa que uma teoria criminal construída com base em casos
individuais de violação criminal não é adequada a ser aplicada como tal em casos de
violações criminais em massa. Ao todo, processar os casos de crimes de guerra não é o
mesmo, nem da mesma maneira, que processar os casos de crime comum.

Na investigação e procedimento criminal por violação massivas dos direitos humanos ou do direito
internacional humanitário, é extremamente importante trabalhar no sentido investigar primeiro as
suspeitas de violação, deduzir depois acusação conjunta dos suspeitos que participaram na mesma
operação criminal, e proceder à detenção dos acusados de forma organizada. Nas violações massivas, os
suspeitos de terem cometido crimes de guerra são heróis para a outro lado do conflito e mantêm circuitos
de comunicação e redes de relações que permitem perturbar as investigações, destruir provas, intimidar
as testemunhas e organizar a fuga à detenção
